For in-person, on-campus after-school or other in-person chess classes

Parents Definition: The term, Parents, within the context of this document, is used to refer to legal parents and legal guardians of minors who are being registered for Rasberry Chess Academy’s (Hereafter RCA) after-school or other in-person Chess Program.

Chess Program Definition: The term Chess Program, within the context of this document, is used to refer to RCA’s after-school, on-campus chess classes and other in-person chess classes and does not refer to online courses, social events (e.g., library chess or girls’ chess night) or tournaments. Separate agreements/releases might be required for those events and will be provided upon registration.

Payment Obligations: Parents have an individual and joint obligation to pay all fees due under this Agreement. Parents acknowledge their responsibilities for paying tuition and other charges (such as late fees) for the Rasberry Chess LLC’s (RCA) Chess Program attendance is unconditional. The sole exception to Parents’ individual and joint obligation to pay all fees due under this Agreement is if RCA cancels a class due to RCA’s fault. In this event, individual class refunds or credits for future classes will be given to Parents. Parents’ failure to pay any amount when due pursuant to the terms of this Agreement, may, at RCA’s sole discretion, may result in the dismissal of the student from the Chess Program.

Payment Due Dates (IMPORTANT): Payments to RCA are due by the first of each month. Failure to pay by the 7th of any month will result in a $15 late fee added to the student’s tuition charge. Failure to pay the month’s tuition and the late fee by the 14th of the month will cause your child to lose their spot in our chess class and the full month’s dues plus the late fee will still be owed by the student’s Parents. 

Cancelation of Service (IMPORTANT): If the student will no longer attend RCA’s chess classes, the Parents must express in writing their desire to stop the Chess Program by the 25th of the previous month to avoid being charged a $30 late cancelation fee. Failure to write the RCA by the 7th of the month will result in the $15 late fee noted above plus the $30 late cancelation fee. Failure to write the RCA by the 14th of the month will result in a full month’s worth of dues owed plus the $15 late fee noted above.

Compliance With Class Host Rules: Parents agree that by entering into this Agreement, Parents and the student agree to accept and abide by the class host’s (school/church/other host) rules, regulations, policies, and standards expressed in the host’s current Parent Handbook (if applicable) and other documents. The host and RCA shall have the right to remove the Student for conduct that violates the host’s rules, regulations, policies, and standards, as determined in the sole and absolute discretion of the host.

Parent Contact Information (IMPORTANT): Parents are each required to keep their updated cell phone and email address on file with RCA. This information may be used for emergency contacts, standard communications, or other important purposes. If either Parent’s cell phone or email address changes, the Parent with the changed information must inform the RCA. Parents agree to respond promptly to all communications from RCA.

Pick-Up Times and Late Fees: Parents must pick up their child no later than 15 minutes after their chess class is scheduled to end unless specifically told a shorter or longer time is allowed in any particular instance. Parents will be charged $15 + $1 per minute for late pick-up after the 15 minute grace period has lapsed. This means if the class ends at 4 PM and pick-up happens at 4:30 PM, a $30 fee will be assessed ($15 initial fee + $1/minute late after 4:15 PM). This fee is due immediately and the parent’s child will not be allowed to return to class until payment has been made.

Disruption of Location Operations: Parents understand that RCA will follow a school, church, or other public entity closure if one is determined by the individual in charge of the class, location, or government. A closure could arise in circumstances including, but not limited to, any act of God (earthquake, hurricane, tornado, etc.), governmental action, or acts or threats of the following: terrorism, pandemic, natural disaster, riot, strike, lockdown, or any event beyond the entity’s reasonable control, or that makes performance inadvisable, impracticable, illegal or impossible. If an entity closure occurs, Parents understand that their obligations under this Agreement remain and will continue and that no portion of any tuition, fees, or other payments made by Parents or that are outstanding will be forgiven or refunded. Pro-rated refunds will be given if entity closures last for any more than one month in length.

Media Permissions Disclaimer: You agree that by joining this RCA Chess Program the student will enter an area where photography, audio, and video recording may occur. By the student’s appearance and participation in this program, you grant Rasberry Chess LLC permission to utilize the player's name, image, likeness, voice, and statements in any live or recorded manner made in connection with, or at, any of these events for all purposes without further authorization from, or compensation to, you. Any exception to this media permissions disclaimer will be considered if the Parents request such an exception in writing with their reasoning for the exception prior to registering for the Chess Program.

Total Agreement of the Parties and Choice of Law Provision: This Agreement constitutes the full and complete agreement between Parents and RCA. No agreement shall alter any provision of this Agreement unless Parents and RCA agree in writing. This Agreement is an integrated writing and any prior oral or written agreements between RCA and Parents are extinguished. Parents and RCA agree that this Agreement shall be interpreted and governed by the laws of the State of Alabama, and that Montgomery County shall be the venue for resolution of all disputes.

By checking the I AGREE box in the Chess Program’s registration, I am certifying that I agree to submit to this Agreement electronically. I have read and accepted all of the terms and conditions on all pages of this Agreement. I understand that I am liable for the total payment and other obligations set forth in this Agreement. I am verifying that I am the person whose name appears at the bottom of the chess program registration page and agree that typing my name there is the legal equivalent to a manual signature on a document. Those who do not agree electronically may print out this Agreement and manually sign it and return it to RCA. I understand that enrollment is based on availability and I am not confirmed until a written confirmation is received. Parents have read and fully understand the terms of the Agreement and agree to and will fully comply with all terms and conditions set forth therein.
